I've been involved in estate planning for 23 years and am always easy to reach. I started my own insurance agency in 1980, and thoroughly enjoyed the business, but my overhead greatly diminished my profits, so in 1982 I moved my office to my home and now pass the savings along to my clients. They were using templates to create the documents, so the only thing that changed, was the clients name, address, and their heirs. Selling Trusts and life insurance created a big conflict of interest. I knew had to sell one or the other, so I stopped selling life insurance and concentrated on Living Trusts. It was long before I decided to cut out the middleman and write the Trusts locally, but there was three hurdles stopping me. 1) There wasn't any software that created professional documents, except for the company I was working for, and they weren't about to sell it to me. I could buy trust kits and fill in the blanks, but that was too labor intensive, and didn't look very professional. 2) At the time, I didn't like computers 3) I was afraid of being charged with practicing law without a license. As luck would have it, I married a woman that year that was computer savvy, who taught me how to create my own templates. I talked to a lawyer who said that article 1, section 10 of the U.S. constitution says, “No state shall pass any laws that would impair the obligation of a contract", and the first amendment says, "Congress shall make no law abridging the right of the people to peacefully assemble." He advised me to establish an association and only help our members, so that year I created the National Association of Estate Planners (NAOEP).
